A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her order, the court noted that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.
